General Information: 

Adoptions

On October 15, 2008, the Government of Vietnam and the Government of the United States agreed that U.S. citizens will not be able to adopt Vietnamese children until both countries sign a new agreement or Vietnam joins the Hague Convention.  While Vietnamese Decree 69/2006 contains provisions that could allow for the adoptions in certain limited cases, including children with medical issues and certain relative adoptions, the Government of Vietnam has not developed the implementing regulations for these procedures.  Accordingly, the Ministry of Justice of Vietnam, U.S. Citizenship and Immigration Services (USCIS), and the U.S. Department of State have determined that neither government will process adoption cases, except for those cases that received an official referral prior to September 1, 2008, until both countries sign a new agreement or both are parties to the Hague Convention.

Relative Petitions - Form I-130:

U.S. citizens that reside in Vietnam can file an Immediate Relative Immigration Petition (Form I-130).

All other I-130 petitions must be filed in the United States.

Waiver - Form I-601:

Waiver applications should be submitted to the U.S. Consulate where the visa was denied following the procedures outlined by the Consulate. The Consulate will forward the application to this office for adjudication and the office will notify the applicant with the results. The processing time may vary depending on the cause for denial and the waiver requirements.

Transportation Boarding Letters

A transportation letter may be issued to a Lawful Permanent Resident to replace a lost or stolen Alien Registration Card (Form I-551) by appearing in person at the Ho Chi Minh City office of Immigration and Custom Enforcement at 65 Le Loi Boulevard, District 1, Saigon Center 9th floor.  Further information please call: 848 3821 6237
