Temporary Workers Visas

H, L, O, P, and Q visas entitle the holder to work legally in the United States. The company or other organization in the United States that intends to hire you needs first to submit a petition to the USCIS (US Citizenship and Immigration Services) in order to obtain permission to hire a foreign worker. If the petition is approved, the company will be issued a form I-797 enabling you to apply for a visa.
In addition to the documentation requirements for visitors, the following documentation is also required for work visa applicants, as well as any other documentation the consular officer may require:

- The original Notice of Approval, Form I-797;

- A copy of the I-129 and all supporting documents as filed with the BCIS;

- A copy of the signed employment contract or a signed offer and acceptance letter specifying terms and conditions of employment, as well as salary;

- For H1B visa applicants, a Labor Conditions Application certification from the United States Department of Labor;

- Proof of current or previous employment/experience and pay slips from related jobs that confirm the applicant's abilities to meet the job requirements in the US;

- Original school transcripts and diploma.

Proof of payment of a non-refundable $500 Fraud Prevention and Detection Fee paid by the petitioners to all H-1B and L visa applicants according to provisions of the INA.  Otherwise, the applicants of blanket L petitions can pay this fee at the US Consulate in cash before or on the interview day.
